INTERSTATE FAMILY SUPPORT: A BENCHBOOK

The purpose of this benchbook is to provide a coherent picture of UIFSA. The benchbook introduces UIFSA's key concepts and ties together UIFSA's provisions, National Conference of Commissioners on Uniform State Law's (NCCUSL) comments and illustrative cases and examples. The benchbook is designed for use in court, by judicial officers and lawyers, as a handy reference source and procedural guide in typical courtroom situations.

An equally important goal is to highlight the interrelatedness of UIFSA's provisions. While some of UIFSA's provisions may stand alone, the better approach is to read and interpret the Act's provisions within the context of the Act's entirety, including its definition section. Thus, several parts of the benchbook repeat select material that pertains to virtually every phase in the child support enforcement process. Cross-references to pertinent UIFSA provisions further underscore the extent to which UIFSA's provisions relate to one another to create a coherent framework for the resolution of interstate family support matters.

The successful implementation of UIFSA and the achievement of its underlying goal of uniformity in the interstate arena, require an unprecedented level of cooperation, communication and deference among and between States as well as their respective courts and other tribunals. By highlighting this fact, the benchbook promotes UIFSA's implementation in a manner consistent with the intent of its drafters - and the U.S. Congress - and thereby seeks to enhance parental responsibility for the support of children and families.
